Spouse moves out

These instructions apply to situations where two tenants share a joint apartment, meaning they have a joint tenancy agreement. Besides spouses, co-tenants include any person on the same tenancy agreement, such as a friend or a sibling. The instructions do not apply to tenants in shared apartments, as in shared apartments each tenant has their own tenancy agreement.

General

  • Neither party to a joint tenancy agreement can terminate the tenancy agreement on their own; both tenants must submit a termination of tenancy for their own part.
  • Usually, both tenants must move out of the apartment, but there are some options for how to proceed in this situation. Please read the instructions carefully so that you know what to do next.

Urgent need to change apartment

When your co-tenant moves out (e.g. in the event of a separation), you can apply for a new Hoas apartment on the basis of urgent housing need if you are a full-time student and meet the right to occupancy criteria.

Staying in the apartment alone with your own tenancy agreement

It is possible to remain in the apartment alone if you are a full-time student and meet the right to occupancy criteria. However, you cannot remain in the apartment if it is particularly large in relation to the number of occupants, or if the apartment is located in Teekkarikylä in Otaniemi and you are not studying at Aalto University.

Instructions:

  1. Submit a termination of tenancy and state in the additional information field that you wish to stay in the same apartment alone.
  2. Immediately after submitting the termination of tenancy, submit a new housing application. Select your current apartment as the target of the application.
  3. Complete the application in the usual way.
  4. Attach a certificate of student status OR, if you are a higher education student, a certificate of enrollment and a transcript of records.

Staying in the apartment alone during the lessor’s notice period

When your co-tenant has submitted a termination of tenancy for their part, you can remain in the apartment for the lessor’s notice period, which is 3 or 6 months depending on the duration of the current tenancy agreement. If you wish to stay in the apartment for the lessor’s notice period, do not submit your own termination of tenancy.

Instructions:

  1. The co-tenant submits a termination of tenancy.
  2. Do not submit your own termination of tenancy.
  3. When you do not submit your own termination of tenancy, Hoas will terminate your tenancy agreement according to the lessor’s notice period.

Good to know:

  • The deposit will be returned to the one who paid it after the lessor’s notice period has ended.
  • If you find a new apartment before the lessor’s notice period ends, you can still terminate your tenancy agreement with a one calendar month notice period.

Staying in the apartment with a new co-tenant

It is possible to remain in the apartment with a new co-tenant when at least one of you is a full-time student and meets the right to occupancy criteria. First, both current tenants must submit their own terminations of tenancy.

Instructions:

  1. Submit a termination of tenancy and state in the additional information that you wish to stay in the same apartment with a new co-tenant. The current co-tenant must also submit a termination of tenancy for their part.
  2. Immediately submit a housing application together with the new co-tenant. Select your current apartment as the target of the application. In the additional information field, state that one of the applicants already lives in the apartment and is now applying for it with a new partner.
  3. Attach at least one applicant’s certificate of student status OR, if the applicant is a higher education student, a certificate of enrollment and a transcript of records.
